alright I have set up an invite only server at xmpp.nz located in Auckland NZ, but will remain here with my personal server account as this one might still work if that one is down for whatever reason at any point.

Probably not legally relevant for NZ, yes. But the same general principles apply if you want to follow best user data protection principles. For example the Brazilian regulations are similar.
